This made the government introduce Assisted Reproductive Techniques (Regulation) Bill, 2014 followed by the Surrogacy (Regulation) Bill, 2016, 2019, and 2020.The Assisted Reproductive Technology (Regulation) Bill, 2020
On September 14, 2020, the Assisted Reproductive Technology (Regulation) Bill, 2020 (ART) was introduced in the Lok Sabha to provide for the regulation of Assisted Reproductive Technology services in the country. The Bill defines ART to include techniques that seek to obtain a pregnancy by handling the sperm or the oocyte (immature egg cell) outside the human body and transferring the gamete or the embryo into the reproductive system of a woman. Examples of ART services include gamete (sperm or oocyte) donation, in-vitro-fertilization (fertilizing an egg in the lab), and gestational surrogacy (the child is not biologically related to the surrogate mother). A child born through ART will be deemed to be a biological child of the commissioning couple and will be entitled to the rights and privileges available to a natural child of the commissioning couple. A donor will not have any parental rights over the child.Eligibility
Earlier, surrogacy was an option only to infertile NRI and Indian married couples who couldn’t conceive during at least five years of marriage. The 2020 amendment also reduced this waiting period along with other changes in surrogacy laws for NRI and Indian married couples. Eligibility for surrogacy includes proof of medical conditions that proves surrogacy as the only option to have a child. These proofs include:- By-birth absence of uterus

- Non-functional uterus
- Uterus removed due to cancer
- Any other chronic condition that eliminates a normal pregnancy
Required Documents for intending NRI/Indian parents
Ensure to have the following documents to initiate the process of surrogacy in India:- A certificate by a district medical board for proven infertility
- Insurance coverage for the surrogate mother for 36 months
- An eligibility certificate ensuring that the intending parents are between ages 23-50 (for females) and 26-55 (for males). This certificate needs to be provided by an appropriate authority and is applicable for NRIs, Indian citizens, PIOs, and foreigners who have married an Indian citizen.
- The couple needs to be married for at least five years and either has no surviving biological or adopted children or has a physically or mentally challenged child. This includes children who suffer from fatal illnesses that have no cure.
